Privacy Policy

I. Definitions

Personal data administrator – Globitell Energia sp. z o.o. with its registered office in Warsaw, ul. Wincentego Rzymowskiego 31, 02-697 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Łódź-Śródmieście in Łódź, XX Commercial Division of the National Court Register under KRS number: 0000755409, NIP: 727 283 39 30. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation data).

Website – maintained by the Administrator at the address: www.globitell-energia.pl, through which the User can communicate with the Administrator.

User – a natural person, a legal person and an organizational unit without legal personality, using the services of Globitell Energia sp. o.o.

II. General provisions

  1. This Privacy Policy applies to the operation of the Website www.globitell-energia.pl, communication and sending messages by Users, including the scope of processing personal data that is necessary for communication with Globitell Energia sp. z o.o. with potential customers and customers outside the Site.
  2. Taking into account the need to protect the privacy of Users, the Administrator in its business activity complies with the obligations arising from the applicable provisions on the protection of personal data, in particular the General Regulation on the Protection of Personal Data of the European Parliament and of the Council (EU) 2016/679 of 27/04/2016 on protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter: GDPR.
  3. The Administrator declares that he processes the User’s personal data while maintaining appropriate technical and organizational measures that ensure this protection.
  4. The personal data administrator, ensuring adequate data protection in the light of applicable standards and knowledge, is not able to exclude the possibility of personal data theft by unauthorized persons.
  5. The administrator of personal data is Globitell Energia sp. z o.o. with its registered office in Warsaw, ul.   6. The User is entitled to contact the Personal Data Administrator in writing at the address indicated in paragraph 5 address or via e-mail.
  7. Globitell Energia sp. z o.o. is the owner of the Website, as well as a service provider in the light of the provisions of the Act of August 26, 2002 on the provision of electronic services.

III. User’s personal data

  1. When using the Website to communicate with Globitell Energia sp. z o.o., the User is obliged to provide personal data, such as name and surname and e-mail address.
  2. Providing personal data by the User is voluntary, but necessary to communicate with Globitell Energia sp. z o.o. via the Site. Lack of personal data will prevent effective use of the Website.
  3. The Administrator also processes Users’ personal data for the period necessary to conclude a contract for the provision of services, as well as until the end of the limitation period, in the event of pursuing claims under the concluded contract.
  4. The Administrator stores Users’ contact details for the purposes of providing services and marketing products and services of Globitell Energia sp. z o.o. until it is determined that an objection to their processing has been raised or consent has been withdrawn – in the case of processing personal data on the basis of the User’s prior consent.
  5. Globitell Energia sp. z o.o., having regard to art. 6 of the GDPR, processes Users’ personal data for the following purposes:
    • communication via the Website with Globitell Energia sp. z o.o.,
    • conclusion of a contract for the provision of services with Globitell Energia sp. z o.o. or by entities acting on its behalf,
    • performance of the contract for the provision of services, in particular ensuring the correct operation of the service, issuing invoices or other accounting documents, handling complaints and ensuring network security,
    • implementation of the legitimate interests of the Administrator or external entities,
    • fulfilling the legal obligation incumbent on the Administrator, resulting from legal provisions or decisions of state authorities,
    • marketing and promotion of services and goods provided by Globitell Energia sp. z o.o. or other entities cooperating with Globitell Energia sp. z o.o.
  6. The Administrator provides the User’s personal data to other entities only for the purpose of using the Website.
  7. The Administrator is entitled to share the User’s personal data with entities that are authorized to receive them under the law.
  8. The Administrator, his employees and entities operating the Website have access to the personal data provided by the User.
  9. Globitell Energia sp. z o.o. reserves the right to transfer personal data to entities processing the User’s personal data at the request of the Administrator, including entities providing services to Globitell Energia sp. z o.o. in technical, organizational or IT solutions, providers of marketing services, providers of accounting, legal and consulting services; other personal data administrators who process data on their behalf, including companies conducting postal and courier activities, banks and institutions conducting payment activities.

IV. User rights

  1. The user whose personal data is processed is entitled to request from the Administrator:
    • access to your personal data,
    • rectification of personal data if they are incorrect,
    • complete personal data if they are incomplete,
    • deletion of personal data in the cases indicated in art. 17 GDPR,
    • limiting the processing of personal data in the cases indicated in art. 18 GDPR,
    • transferring his personal data,
    • withdraw consent to the processing of personal data at any time.
  2. Withdrawal of the consent referred to in par. 8 points g does not affect the lawfulness of the processing of personal data, which was made on the basis of previously expressed consent.
  3. The user has the right to object to the processing of his personal data.
  4. The User also has the right to lodge a complaint with the President of the Office for Personal Data Protection if it is found that the processing of his personal data violates the provisions of the GDPR.
  5. The User’s request to delete personal data necessary to communicate with Globitell Energia sp. z o.o. and the provision of services is the User’s declaration of termination of the contract for the provision of services and causes the effects specified in the Regulations.
  6. The Website uses the Google Analytics system, Google AdWords, as well as other analytical tools enabling the User to use the Website.

V. Changing the Privacy Policy

This Privacy Policy is subject to ongoing verification and updating if necessary. The current version of the Privacy Policy has been adopted and is effective from January 2019.
